A 2-hour seminar for DBPR licensed agents/brokers. In this presentation, we will describe and discuss commonly encountered issues which create delays or cancellations of pending transactions and provide possible solutions.

We will analyze legal issues arising from title insurance requirements relating to dissolution of marriage, probate, trusts, co-ops and other issues which cause delay when not properly addressed prior to closing.

We will also address matters not generally covered under the title insurance policy and distinguish those that must be cleared or listed as exceptions to coverage including building permits, municipal liens, and association estoppel/lien/right of first refusal questions.

Survey issues are also covered as to the uses and need for surveys to be provided to the customers / title agency along with an overview of the mechanics of deletion of the survey exception to provide survey coverage to the customer.

Finally, we will review and discuss commonly seen legal capacity and signing issues including rules related to allowable uses of powers of attorney and the need to recognize capacity concerns early in the process where persons may not have the capacity to understand the nature and effect of the transaction or be able to execute legal documents without a valid POA, guardianship or court order.
